Beta Notice: HasIt is currently offered as a beta / early access service. Features, functionality, and these Terms may change frequently and without the notice period that would apply to a fully launched product. The Service is provided on an as-is basis during this period, and you may encounter bugs, incomplete features, or downtime. See Section 15 for more on beta status.
These Terms of Service (“Terms”) form a binding agreement between you and BuildIt Inc. (“HasIt,” “we,” “us,” or “our”), governing your access to and use of the HasIt website, mobile web application, and related services (collectively, the “Service”).
By creating an account or otherwise using the Service, you agree to these Terms. If you do not agree, do not use the Service.
HasIt is a platform that lets users catalog their own tools and consumables (their “Stuff”), connect with mutual friends (a “Bench”), and coordinate lending, borrowing, and giving away items directly with one another. HasIt also offers AI-assisted features to help plan projects and catalog items from photos.
HasIt is a coordination tool, not a party to any exchange between users. We do not own, inspect, insure, warrant, or take possession of any item listed, lent, borrowed, or given away through the Service. Every borrow, loan, or giveaway is an agreement solely between the users involved. See Section 8 for details on how this affects your rights and risks.
You must be at least 13 years old to use HasIt. If you are between 13 and 17, you may only use the Service with the involvement and permission of a parent or legal guardian, who is responsible for your use of the Service and any items you lend, borrow, or exchange with other users. HasIt does not currently verify age or parental consent beyond what you represent to us, so parents and guardians of minor users should supervise their use of the Service directly.
You sign up and log in using Google Sign-In or Sign in with Apple. You are responsible for maintaining the confidentiality of your account credentials with those providers and for all activity that occurs under your HasIt account. Notify us promptly if you believe your account has been compromised.
You agree to provide accurate profile information (name, photo, and optionally a general area) and to keep it current.
Access to another user’s Stuff requires a mutual, accepted connection (“Bench” connection). Only mutual connections can view each other’s Stuff or request to borrow. This is a hard access boundary enforced by the Service, not a setting you or another user can bypass. You may remove a Bench connection at any time; doing so ends future visibility but does not erase the historical record of past transactions between you and that user.
“User Content” means anything you upload or submit through the Service, including item listings, item and condition photos, notes, terms, project descriptions, and messages related to borrow requests.
You are solely responsible for your User Content, including its accuracy and legality, and for the actual condition, safety, and legal status of any item you list or lend. Listing an item on HasIt does not mean HasIt has verified you own it, that it is safe to use, or that it is legal to lend, borrow, or give away in your jurisdiction.
You grant HasIt a worldwide, non-exclusive, royalty-free license to host, store, reproduce, and display your User Content as necessary to operate the Service, including showing your Stuff to your Bench connections, maintaining loan and condition-photo history, and processing your content through AI features as described in Section 6. This license ends when you delete the relevant content or your account, except for copies retained as described in Section 9 (Data Retention) or as required by law.
You will not post User Content that is unlawful, infringing, fraudulent, or that misrepresents an item’s condition, ownership, or safety in a way likely to mislead another user.
HasIt offers two AI-assisted features, processed using third-party AI providers (currently Anthropic and OpenAI):
You describe a project in your own words, and HasIt generates a suggested list of steps and required tools/materials, cross-referenced against your own Stuff and Bench. Generated plans are saved to your account and can be revisited or deleted.
You submit a photo of one or more tools, and HasIt uses AI to detect items and generate draft entries for your Stuff (name, category, suggested condition) for your review. Nothing is saved to your Stuff until you review and confirm each entry.
To provide these features, the text and photos you submit for AI processing are sent to our third-party AI providers for that purpose. Do not submit photos or descriptions containing sensitive personal information about yourself or others beyond what’s needed to identify or plan around your tools.
AI-generated content, including project steps, tool/material lists, item identification, and condition guesses, may be incomplete, inaccurate, or unsuitable for your specific situation. You are responsible for independently verifying safety-relevant information before acting on it, including for projects involving power tools, structural work, electrical work, or other activities with injury or property-damage risk. AI-generated instructions are general guidance only and are not a substitute for manufacturer instructions, local building codes, or professional advice.
When you request, accept, arrange, or complete a borrow, return, or giveaway through the Service, you are entering into an arrangement directly with the other user, not with HasIt. HasIt provides tools to track status (requested, accepted, active, returned, closed) and to prompt condition photos at pickup and return, but does not participate in, guarantee, insure, or enforce the arrangement itself.
Photos taken at pickup and return are stored as a timestamped reference and are viewable by both parties to that loan. HasIt does not review, verify, or arbitrate the condition shown in these photos.
If a dispute arises between users over a lost, damaged, late, or misrepresented item, HasIt is not responsible for resolving it and does not arbitrate, mediate, or adjudicate user-to-user disputes. Users are responsible for resolving disagreements directly, including through any legal remedies available to them outside the Service.
You use the borrowing, lending, and giveaway features at your own risk. This includes the risk that an item is damaged, lost, not returned, misrepresented, unsafe, or that another user fails to honor an arrangement. You are solely responsible for deciding whether to lend to or borrow from another user.

We may investigate and take action, including account suspension or termination, for violations of this section.
Loan history, including condition photos, is retained indefinitely by default so it remains available as a reference for both parties. You can request deletion of your account and associated data by contacting us at support@hasit.dev; some records may be retained where required for legal, security, or dispute-related purposes even after account deletion.
This section is a summary. Our full Privacy Policy describes what we collect, how we use it (including sharing with AI providers under Section 6), and your rights in more detail. (Privacy Policy not yet published — separate task.)
You may stop using the Service and delete your account at any time. We may suspend or terminate your account if you violate these Terms, misuse the Service, or if required by law. Sections that by their nature should survive termination (including Sections 7, 8, 11, 12, 13, and 14) will survive.
THE SERVICE, INCLUDING ALL AI-GENERATED CONTENT, IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. HASIT DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, OR THAT AI-GENERATED CONTENT WILL BE ACCURATE OR SAFE TO RELY ON. HASIT MAKES NO WARRANTY REGARDING THE CONDUCT, RELIABILITY, OR HONESTY OF ANY OTHER USER, OR THE CONDITION, SAFETY, OR LEGALITY OF ANY ITEM LISTED, LENT, BORROWED, OR GIVEN AWAY THROUGH THE SERVICE.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, HASIT AND ITS OWNERS, EMPLOYEES, AND CONTRACTORS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICE, INCLUDING ANY LOSS, DAMAGE, OR INJURY ARISING FROM AN ITEM LENT, BORROWED, OR EXCHANGED WITH ANOTHER USER, OR FROM RELIANCE ON AI-GENERATED CONTENT. HASIT’S TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING FROM THE SERVICE WILL NOT EXCEED $100.
Some jurisdictions do not allow certain limitations on liability, so some of the above limitations may not apply to you.
You agree to indemnify and hold harmless HasIt and its owners, employees, and contractors from any claims, damages, losses, and expenses (including reasonable attorneys’ fees) arising from your use of the Service, your User Content, your violation of these Terms, or any dispute between you and another user, including disputes arising from a borrow, loan, or giveaway arrangement.
Please read this section carefully. It affects your legal rights, including your right to go to court.
Except for disputes that qualify for small claims court or that involve intellectual property, you and HasIt agree to resolve any dispute arising from these Terms or the Service through binding individual arbitration, rather than in court, except as set out below.
You and HasIt agree that any arbitration or claim will be conducted on an individual basis only, and not as a class, collective, or representative action.
Either party may bring an individual claim in small claims court instead of arbitration, if the claim qualifies.
You may opt out of this arbitration agreement by emailing support@hasit.dev within 30 days of first agreeing to these Terms, stating your name and that you wish to opt out of arbitration. If you opt out, disputes will be resolved in the courts described in Section 15.
Arbitration will be administered by a recognized arbitration provider (e.g., the American Arbitration Association) under its rules then in effect, with the arbitration seated in Dallas County, Texas unless you and HasIt agree otherwise.
These Terms are governed by the laws of the State of Texas, without regard to conflict-of-law principles. For any dispute not subject to arbitration under Section 14, you and HasIt agree to the exclusive jurisdiction of the state and federal courts located in Dallas County, Texas.
HasIt is in beta / early access. During this period:
We’ll aim to communicate material changes, but you should not treat the Service as a durable system of record during the beta period.
We may update these Terms from time to time. If we make material changes, we’ll take reasonable steps to notify you (such as an in-app notice or email). Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
Entire agreement. These Terms (together with our Privacy Policy) are the entire agreement between you and HasIt regarding the Service.
Severability. If any provision of these Terms is found unenforceable, the remaining provisions remain in effect.
No waiver. Our failure to enforce any provision is not a waiver of our right to do so later.
Assignment. You may not assign these Terms without our consent. We may assign these Terms in connection with a merger, acquisition, or sale of assets.
HasIt offers an optional text-messaging feature that lets you text a dedicated HasIt phone number to record a borrow (for example, “I borrowed Steve’s impact driver”), instead of using the in-app borrow flow. This section applies if you choose to add a phone number and opt in to this feature.
You are never required to provide a phone number or opt in to text messaging to use HasIt. You opt in by checking the consent checkbox next to the phone field in your profile settings; that checkbox is never pre-selected. Providing a phone number without checking that box will not enroll you in text messaging.
Once opted in, you may receive text messages related to recording a borrow by text: confirmations that a borrow was logged, requests to clarify which friend or item you mean, requests to confirm a new item a friend added on your behalf, one-time verification codes to help secure your account, and similar transactional messages tied to those features. Message frequency varies depending on how often you use this feature and is not on a fixed schedule.
Message and data rates may apply. HasIt is not responsible for any charges from your wireless carrier, or for delayed or undelivered messages caused by your carrier or device.
Reply HELP to the HasIt number for help, or STOPat any time to opt out; you will stop receiving texts from HasIt once you do. Opting out only affects this text-messaging feature — it does not affect your HasIt account or your ability to use the Service through the app. You can also remove your phone number, or opt back in, at any time from your profile settings.
A borrow recorded by text is subject to the same terms as one recorded in-app, including Section 7 (Borrowing, Lending, and Giveaways). You are responsible for the accuracy of what you text us, including which friend and item you mean; HasIt uses automated (AI-assisted) matching to interpret your message, which may occasionally misinterpret an ambiguous text.
